What changed

The U.S. Court of Appeals for the Tenth Circuit proposed Rule 46.5 revisions under which presenting a filing would certify that any document prepared with generative AI was reviewed by a human who independently verified cited authorities, quotations, citations, legal analysis and compliance obligations.

Why it matters

The proposal converts general professional responsibility into an explicit appellate filing representation backed by issue waiver, striking, dismissal, monetary sanctions, discipline and fee awards.

What to do

Map every AI-assisted appellate workflow to a named reviewer who opens the underlying authorities and record, checks each proposition and quotation, verifies court and ethics rules, and preserves dated review evidence. Submit comments before the court's deadline if the rule affects your practice.

Caveat

This is a proposal open for comment through 18 October 2026, not an operative rule. The court plans final 2027 rules by 30 November; scope and wording may change before the stated 1 January 2027 effective date.
